1. Who we are and acceptance
Postxport (“Postxport”, “we”, “us”) is a video review and collaboration service operated by Xplained. By creating an account, accessing, or using the service, you agree to these Terms of Use and to our Privacy Policy. If you are using Postxport on behalf of an organisation, you confirm you are authorised to bind that organisation to these terms.
If you do not agree, do not use the service.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract. The service is intended for professional and business use and is not directed at children.
3. Your account
You are responsible for the accuracy of the details you provide, for keeping your password confidential, and for all activity under your account. Notify us immediately at hi@postxport.com if you suspect unauthorised access. You may enable two-factor authentication where offered.
4. Early access
Postxport is an early-stage product under active development, provided on an invite or waitlist basis. Features may change, be limited, or be withdrawn, and occasional interruptions may occur. Keep business-critical original files backed up elsewhere; we are not a system of record for your masters.
5. Your content
You and your team retain all ownership of the videos, comments, messages, files, and other material you upload (“Your Content”). You grant us a limited, worldwide, royalty-free licence to host, store, process, transmit, transcode, generate transcripts and thumbnails from, and display Your Content solely to operate and provide the service to you and the people you share it with. This licence ends when the content is deleted, subject to routine backup retention described in the Privacy Policy.
You are responsible for Your Content and confirm you have the rights and consents necessary to upload and share it, including any rights of people appearing in your footage.
6. Acceptable use
You agree not to use Postxport to: upload or share content that is unlawful, infringing, defamatory, or that you have no right to share; upload malware or attempt to breach, probe, or disrupt the service or its security; reverse engineer, scrape, or resell the service except as permitted by law; impersonate others or misuse invitations and share links; or use the service to harass or harm others. We may suspend or remove content or accounts that violate these terms or applicable law.
7. Sharing and guest reviewers
Share links and client invitations let people outside your workspace view or comment on specific content. You control what you share and the expiry or password on each link, and you are responsible for what you choose to make accessible. Guests must also comply with these terms.
8. Third-party services
The service integrates third-party processors (for email delivery, sign-in, bot protection, and transcription) as described in the Privacy Policy. Your use of those features is also subject to the relevant provider's terms. We are not responsible for third-party services we do not control.
9. Intellectual property
The Postxport software, design, trademarks, and content we provide are owned by us or our licensors and are protected by law. These terms grant you a limited, non-exclusive, non-transferable right to use the service; they do not transfer any of our intellectual property to you.
10. Fees
During early access the service is offered without charge unless we agree otherwise with you in writing. If we introduce paid plans, we will give notice and any pricing terms will apply prospectively; you may stop using paid features rather than accept new charges.
11. Suspension and termination
You may stop using the service and delete your account at any time from Settings. We may suspend or terminate access if you materially breach these terms, create risk or legal exposure, or if we discontinue the service. On termination, your right to use the service ends and Your Content is handled as described in the Privacy Policy's retention section.
12. Disclaimers
To the maximum extent permitted by law, the service is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, availability, or that the service will be uninterrupted, error-free, or that data will never be lost. You use the service at your own risk.
13. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for loss of data, profits, or goodwill. Our total aggregate liability arising out of or relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim, or INR 5,000 (or local equivalent). Nothing in these terms excludes liability that cannot be excluded by law.
14. Indemnity
You agree to indemnify and hold us harmless from claims arising out of Your Content, your use of the service, or your breach of these terms or applicable law, to the extent permitted by law.
15. Changes to these terms
We may update these terms as the product and our obligations evolve. When we make material changes we will update the “Last updated” date and ask you to re-accept the current terms the next time you sign in. Continued use after changes take effect means you accept the updated terms.
16. Governing law and disputes
These terms are governed by the laws of India, and the courts at our principal place of business will have jurisdiction, without prejudice to any mandatory consumer-protection rights you have in your country of residence.
